This Policy describes the types of information we may collect from you or that you may provide when you visit or use The Osler web platform, simulation engine, and Institutional Portal (collectively, the "Platform"), and our practices for collecting, using, maintaining, protecting, and disclosing that information.

  • Clinical Actions: Physical exam maneuvers narrated, diagnostic tests ordered, and treatments proposed.
  • Gameplay Metrics: Time spent on cases, resource/budget efficiency, and participation logs in "Clinical Duels."

1.3 Performance Analytics

2. NO REAL-WORLD HEALTH DATA (PHI)

The Osler is an educational simulation tool. You must never input real patient names, actual medical records, or real-world Protected Health Information (PHI) into the Platform. All patient data presented by the system is fictitious. Any real-world PHI accidentally entered by a user will be treated as a violation of our Terms of Service and will be permanently deleted upon discovery.

3. HOW WE USE YOUR INFORMATION

We use the information we collect to operate, evaluate, and improve the Platform:

  • To power the AI simulation engine and generate accurate, dynamic conversational responses during clinical cases.
  • To calculate and generate your deeply detailed performance analytics and clinical rationale feedback.
  • To populate your personal career metrics dashboard and maintain your permanent case archive.
  • To populate the Institutional Portal with macro and micro-level academic tracking data.
  • To ensure academic integrity by preventing case replay manipulation or cheating in Clinical Duels.
  • To improve our proprietary grading algorithms and AI guardrails.

4. INSTITUTIONAL ACCESS & SHARING (B2B EDTECH)

4.1 University Administrators and Faculty

If your account is provided by or linked to a medical school, university, or enterprise institution, your performance data is not private from your institution.

By using the Platform, you acknowledge that authorized administrators and faculty at your institution have unprecedented academic transparency via the Institutional Portal. They can view, track, and export:

  • Your overall performance trajectories.
  • Your specific analytics and grading matrices on any single clinical case.
  • Full chat transcripts and diagnostic steps taken during your simulations.

4.2 De-Identified & Aggregated Data

We reserve the right to anonymize, de-identify, and aggregate simulation data (including chat transcripts and clinical actions) so that it can no longer be reasonably used to identify any individual user or institution. We may use, share, license, or commercialize this de-identified data for any legal purpose, including but not limited to medical research, industry benchmarking, and the training or development of third-party artificial intelligence models.

4.3 Legal Compliance

We may disclose your information if required to do so by law, court order, or governmental regulation, or to enforce our Terms of Service and protect the rights, property, or safety of The Osler, our users, or others.

5. ARTIFICIAL INTELLIGENCE & DATA PROCESSING

5.1 Artificial Intelligence & Data Processing

The conversational prompts and clinical actions you input into The Osler are used to evaluate your performance in real-time. Because this data holds immense value for the advancement of medical AI, we may commercialize or share your conversational data with third-party foundational model providers. However, we will never share your personal identity. Any data utilized for third-party machine learning or AI training will be strictly de-identified and disconnected from your name, email, and institutional affiliation prior to transfer.

5.2 Internal Algorithm Improvement

We may securely use anonymized and aggregated simulation data to fine-tune our proprietary grading algorithms, improve our AI conversational guardrails, and develop new clinical cases.

6. DATA SECURITY

We implement industry-standard administrative, technical, and physical safeguards designed to secure your personal information from accidental loss and unauthorized access, use, alteration, and disclosure. All data transmissions between your browser and our servers are encrypted. However, the transmission of information via the internet is not completely secure, and we cannot guarantee the absolute security of your data.

7. USER PRIVACY RIGHTS (GDPR, KVKK, & FERPA)

Depending on your geographic location and institutional affiliation, you may have specific rights regarding your personal data:

  • Access and Correction: You may view and review your permanent archive of clinical encounters via your profile dashboard.
  • Deletion Requests (Institutional Users): Because The Osler acts as an educational data processor for universities, student requests to delete academic records or accounts must be directed to your university administrator. We cannot unilaterally delete academic grading records without authorization from the institution that holds the enterprise license.
  • Independent Users: If you purchased an individual license directly, you may request account deletion by contacting us directly.

8. INTERNATIONAL DATA TRANSFERS

The Osler operates globally. Your information may be transferred to, stored, and processed in servers located outside of your resident country (including Turkey, the EU, or the US). By using the Platform, you consent to the transfer of your data to our secure data centers in accordance with applicable data protection laws.

9. CHANGES TO OUR PRIVACY POLICY

We may update this Privacy Policy from time to time. If we make material changes to how we treat our users' personal data, we will notify you through a notice on the Platform or via email to your primary account address. Your continued use of the Platform after such modifications constitutes your acknowledgment of the updated Privacy Policy.
