TERMS OF SERVICE
Effective Date: August 12, 2026Welcome to The Osler. These Terms of Service ("Terms") govern your access to and use of The Osler web platform, institutional portal, simulation engine, and all related services (collectively, the "Platform"), provided by The Osler, Education Technologies ("Company," "we," "our," or "us").
By accessing or using the Platform, you ("User," "Student," or "Institution") agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.
1. CRITICAL MEDICAL & EDUCATIONAL DISCLAIMER
1.1 Educational Purposes Only
The Osler is an educational simulation platform intended solely for academic training and study purposes. It does not provide medical advice, formal clinical diagnosis, treatment recommendations, or real-world clinical decision support.
1.2 No Real-World Application
The clinical scenarios, physical exam findings, laboratory results, and AI-generated conversational feedback are entirely simulated. Users must never apply the diagnostic reasoning, treatment paths, or outcomes experienced on the Platform to real-world patients.
1.3 No Doctor-Patient Relationship
Use of the Platform does not create a doctor-patient relationship between The Osler and any individual. The Osler and its founders, employees, and Medical Advisory Board bear absolutely no liability for real-world medical decisions, injuries, or malpractice claims arising from a User's reliance on information learned or simulated on the Platform.
2. PLATFORM ACCESS AND ACCOUNTS
2.1 Institutional vs. Individual Users
Access to the Platform is generally provided through enterprise agreements with universities or medical institutions ("Institutional Portal"). If your access is provided by an institution, your account remains subject to your university's academic policies in addition to these Terms.
2.2 Account Security
Users are responsible for maintaining the confidentiality of their login credentials. You may not share your account, transfer your account, or allow any third party to access the proprietary simulation database. You must notify us immediately of any unauthorized use of your account.
3. ACADEMIC INTEGRITY & PLATFORM MECHANICS
3.1 Case Locking & Fair Play
To protect academic integrity and ensure accurate performance analytics, clinical cases on The Osler operate on a strict, single-attempt basis. Once a case is completed or abandoned, it is permanently locked and cannot be replayed or altered to manipulate performance metrics.
3.2 Clinical Duels
Users participating in competitive multiplayer simulations ("Clinical Duels") agree to participate fairly. Any attempt to exploit system latency, use third-party scripts, or cheat during a live duel will result in immediate account suspension.
3.3 Institutional Analytics Visibility
Students utilizing accounts provided by their university acknowledge that their performance analytics, chat logs, grading matrices, and platform usage data are visible to their university administrators and faculty through the Institutional Portal.
4. ARTIFICIAL INTELLIGENCE AND SIMULATION GUARDRAILS
4.1 AI Conversational Wrapper
The Osler utilizes artificial intelligence strictly as a conversational patient interface layered over a locked, medically reviewed data matrix. While we implement strict guardrails to prevent AI hallucinations, the AI dynamically generates text based on User inputs.
4.2 Limitation on AI Outputs
The Osler makes no absolute warranties regarding the flawless nature of the AI's conversational output. If the AI exhibits unexpected behavior, the User must rely on their clinical judgment and the objective case data provided (e.g., lab results). The Osler is not liable for academic penalties or misunderstandings resulting from the conversational AI wrapper.
5. INTELLECTUAL PROPERTY AND RESTRICTIONS
5.1 Proprietary Content
The Osler retains all right, title, and interest in and to the Platform, including but not limited to the proprietary grading algorithms, the clinical database of over 5,000 handwritten cases, the UI/UX design, and the underlying AI simulation architecture.
5.2 Prohibited Conduct
Users and Institutions are strictly prohibited from:
- Data Scraping: Copying, scraping, exporting, or mass-downloading clinical cases, chat histories, or evaluation matrices to build competing products or train external AI models.
- Reverse Engineering: Attempting to reverse engineer, decompile, or bypass the proprietary grading algorithms or the locked data matrix of the simulation engine.
- Commercial Exploitation: Reselling, sublicensing, or using the Platform for any commercial purpose outside of the agreed institutional use.
5.3 Prohibition of Personal Information in Simulations
The simulation chat interface is designed strictly for clinical inputs. You agree that you will not input your own name, contact information, university name, or any other Personally Identifiable Information (PII) into the chat interface. Any personal information voluntarily entered into the simulation engine is done at your own risk and constitutes a violation of these Terms. We reserve the right to delete or redact such information upon discovery.
6. FEES AND PAYMENT (INSTITUTIONAL USERS)
Where applicable, enterprise access is governed by a separate Institutional Service Agreement or Order Form. Institutions agree to pay all fees specified in their respective agreements. Unless otherwise stated, all fees are non-refundable. Suspension of an institutional account for non-payment will result in the suspension of all associated student sub-accounts.
7. DISCLAIMER OF WARRANTIES
THE PLATFORM AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES' RIGHTS, AND THE WARRANTY OF FITNESS FOR PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE PLATFORM WILL OPERATE ERROR-FREE OR THAT IT IS FREE OF COMPUTER VIRUSES OR SIMILAR CONTAMINATION.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL The Osler, Education Technologies, ITS FOUNDERS, AFFILIATES, MEDICAL ADVISORY BOARD, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE PLATFORM;
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM;
- ANY APPLICATION OF SIMULATED KNOWLEDGE TO REAL-WORLD MEDICAL PRACTICE;
- ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
9. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless The Osler, Education Technologies, its officers, directors, employees, founders, and agents, from and against any claims, actions, demands, damages, losses, liabilities, costs, or expenses (including reasonable legal and accounting fees) arising out of or relating to:
- Your breach of these Terms;
- Your misuse of the Platform;
- Any real-world medical decisions, actions, or omissions made by you based on your use of the Platform.
10. GOVERNING LAW AND DISPUTE RESOLUTION
10.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ankara, Turkey, without regard to its conflict of law provisions.
10.2 Dispute Resolution & Arbitration
Any dispute arising from these Terms or the use of the Platform shall be resolved exclusively through binding arbitration in Ankara, Turkey, rather than in court. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
11. GENERAL PROVISIONS
11.1 Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Effective Date." Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
11.2 Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
11.3 Force Majeure
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
